General Rental Conditions
Article 1: General Rental Conditions The renter must be 18 years or older.
They agree to pay for the rental and deposit a security deposit of €1700 for the beginner pack and €3500 for the advanced pack before receiving the full Wingfoil equipment.
The security deposit will be fully refunded when the equipment is returned in good condition. In case of damage to the equipment, the repair costs will be deducted from the deposit.
For example:
- Impact on the foil board: €40 to €100.
- Tear on the wing: €50 to €150.
- Damage to the foil: on estimate.
Article 2: Equipment Condition
The renter acknowledges the perfect working condition of the provided equipment. The renter must return all equipment and accessories in their entirety at the end of the rental. If not, the renter will pay the full cost of replacing the equipment to the lessor.
The equipment must be returned in its entirety and in good condition, under penalty of criminal charges for abuse of trust.
For any damage caused to the equipment or accessories, the lessor “Noremana” must be compensated by the renter. The costs will be determined based on an estimate by the lessor.
Article 3: Renter’s Responsibility
The renter is legally responsible for the rented equipment during the rental period and thus assumes responsibility for it.
Unless proof of failure is provided, the renter becomes responsible for any damage that the equipment may cause upon taking possession of it.
The renter assumes full responsibility for the use of the equipment and declares to have the necessary skills for its use.
The renter is fully responsible for any actions they take during the rental period.
The renter may not:
- Use the rented equipment for any purpose other than its normal intended use.
- Use the equipment under conditions different from those for which the rental was made.
- Violate the safety rules established by both the current regulations and the lessor.
The renter agrees for themselves and on behalf of all participants they represent to:
- Return all equipment covered by this agreement to the lessor in its original condition.
- Have valid personal liability insurance at the time of the rental.
- Not have any physical or medical contraindications to practicing the activity.
- Not navigate under the influence of alcohol.
- Not transport or consume alcohol or drugs during the rental period.
- Have liability insurance to cover damages caused to third parties by the equipment and damages sustained by the equipment. The renter assumes responsibility for the financial consequences of these damages.
The renter remains solely responsible for any violations committed by them or their agents and bears the criminal, civil, and fiscal consequences.
If the lessor pays for any costs related to these violations, the renter agrees to reimburse the lessor upon justified request.
Under no circumstances can Noremana be held responsible for any cause in the event of a dispute arising with the client regarding breakage, loss, or theft of the equipment.
Noremana advises its clients on the obligation to have proper civil liability and personal insurance for practicing Wingfoil.
Noremana is not able to accurately assess the level of Wingfoil skills (and responsibility) of its clients and cannot be held responsible for injuries, accidents, or death while practicing Foil with rented equipment.
Each individual practices Wingfoil under their own responsibility, being aware of their level and the potential risks associated with currents, tides, weather, fauna, and flora of the environment in which they practice Wingfoil.
The practice of Wingfoil involves certain inherent risks, dangers, and hazards that can cause serious injuries and death to both the “renter” and third parties. We advise using a flotation vest, helmet, and neoprene boots (not provided in the rental) for foil practice.
By renting, the client implicitly acknowledges having the technical competence necessary to use the equipment they have rented independently. Upon receiving the equipment, the client assumes full responsibility for themselves and any third parties, as well as the equipment entrusted to them.
The renter acknowledges having read and understood the navigation and safety regulations outlined above.
Article 4: Weather
No refunds will be made due to poor or non-existent conditions or unfavorable weather.
